Kick me out of my apartment? (TX)?

According to Texas leases, can your apt kick you out for not paying your rent on time? I mean, we're talking ONE DAY late...I've lived in the same apt for 2 years,never been late once,just managed to forget this time b/c my mom has been really sick. Does anyone have any knowledge on this? THANKS

I would read over your contract. It should list the offenses that will can lead to eviction. It will probably even list the number of days of non-payment that will lead to an eviction. That should tell you whether they can.





what they can't do is kick you out with anything less than 30 days notice. That is 30 days from the notice arriving at your door step or mail box (not necessarily when you find it, or pick it up). Find the website for the states housing office. You will find information on landlord, and tenant rights. You can waive that under their nose and demand you right to a timely move out if they do have justification. If they still force you out, or make it unliveable for you before your authorized time frame, then you can sue them in small claims court for whatever money it cost you for the early eviction.





P.s. One possible reason they want you out, even though you have only been late once is they have other issues against you as a tenant - or, they are looking to raise rents, which they can't do until your current lease agreement expires.

Reply:Well, technically they can but lets not forget you are a paying customer. They aren't just gonna throw you out just because of that. They will however most likely charge a late fee, and if they are really mean they can take back any concessions you might have like if you have a discount or something. They can force you to pay it all back.





By the way, the eviction process is very long and drawn out, so they would have to go through a 3 month legal battle in order to have you evicted. The chances of them choosing to do that over letting you pay your rent late are slim to none.
Reply:Technically, your landlord has the right to start eviction proceedings if your even one day late. Texas is a VERY landlord friendly state, so make sure rent is paid on time.
